FIXED TERM EMPLOYMENT CONTRACT
made and entered into by and between
JUCELE FOOTBALL CLUB (PTY) LIMITED
(hereinafter referred to as “JUCELE”)
and
(hereinafter referred to as “the Head Coach”)

- APPOINTMENT
- The Head Coach is appointed as
Head Coach of Jucele on the terms and conditions set out in this contract. The appointment is fixed term in nature and
will expire by effluxion of time.
- The position of Head Coach is one
which requires flexibility and the Head Coach appreciates that the nature and
ambit of the position will be amplified in discussion with the Head Coach and
management from time to time.
- Jucele is entitled to make changes to the Head Coach’s responsibilities from time to time and as the requirements of the game of football and the club change subject to the amendments being limited to those reasonably related to the position, and as far as these changes don’t affect his position as Head Coach.
- The Head Coach is appointed as
Head Coach of Jucele on the terms and conditions set out in this contract. The appointment is fixed term in nature and
will expire by effluxion of time.
1.4 The Head Coach is required to report to the offices and training and playing fields of Jucele or where Jucele will be training or playing as required according to training schedules, meetings and team functions and to work such hours as are necessary to ensure that his functions are properly fulfilled.
- The Head Coach will carry out his duties in accordance with the provisions of this contract read with the Jucele Employee Handbook which is incorporated by reference. The Head Coach warrants that each of the undertakings, options and restraints recorded in this contract are reasonable and necessary in consequence of the special nature of the sport of football and Jucele as a club.
- In the event of contradiction between this letter of appointment and the Employee Handbook, this letter of appointment will prevail.
- The
clause of transfer of employees as set out in the Employee handbook clause (6)
does not apply to the Head Coach.
- CONTRACT
PERIOD
- This contract will commence on and terminate by effluxion of time on the last day of or this contract is terminated in terms of its provisions hereof prior to the termination date. The probation period as depicted in the Club Handbook shall not apply to this contract.
- It is recorded that the Head Coach is currently years of age and his employment will terminate on the termination date and he will not take retirement prior to that date.
- TERMINATION AND NOTICE
This contract is terminable by Jucele on one (1) month’s written notice-- should the Head Coach breach any of the terms of this contract; or
- on any of the grounds set out in the Jucele Employee Handbook.
- Should the Contract be
terminated by mutual consent, both parties will agree on a settlement at that
time,
- WORKING
HOURS
- Ordinary working hours are scheduled
in accordance with Jucele’s training program but will require flexible hours
due to the nature of the job. In
addition, the Head Coach acknowledges that the nature of the contract is such
that weekend work will be required in order to fulfill fixtures as determined
by the federations, as well as any friendly matches or exhibitions or social
responsibility/marketing projects as undertaken by Jucele from time to
time. In such event, the Head Coach is
contractually obliged to work such overtime, weekends or public holidays as the
case may be.
- The nature of the sport of
football; and the position of Head Coach are such that the Head Coach
undertakes to work such hours as are necessary to meet the requirement of the
position and will not be entitled to or seek overtime or other such pay in
consequence.
- The Head Coach warrants in
particular that he appreciates that he will be required to travel to matches
away from home and that he will do so as part of the agreed work time contemplated
in this contract.
- Ordinary working hours are scheduled
in accordance with Jucele’s training program but will require flexible hours
due to the nature of the job. In
addition, the Head Coach acknowledges that the nature of the contract is such
that weekend work will be required in order to fulfill fixtures as determined
by the federations, as well as any friendly matches or exhibitions or social
responsibility/marketing projects as undertaken by Jucele from time to
time. In such event, the Head Coach is
contractually obliged to work such overtime, weekends or public holidays as the
case may be.
- REMUNERATION, BONUSES AND INCENTIVES
5.1 The Head Coach will be paid a gross monthly salary of per month payable monthly in arrear, increasing at a rate of CPIX for the immediately preceding annum.
- The Head Coach will be entitled to the following gross bonuses and benefits:
- Upon Jucele winning the Premier Soccer League Championship, the Head Coach shall be paid a gross bonus of ;
5.3.2 Upon Jucele winning any CUP competition played under the auspices of the Premier Soccer League, the Head Coach shall be paid a gross bonus of . Should the club be finalists of any Cup Competition as listed above, the Head Coach will receive double the bonus the players are entitled to.
5.3.3. Upon Jucele winning the ASSOCIATION Champions League, the Head Coach shall be paid a gross bonus of .
5.3.4 A Club cell phone with $ per month worth of airtime;
5.3.5 Option of joining the Club’s medical aid scheme with the Club contributing as per the Country Revenue Services directive.
5.3.6 Transportation will be provided by Jucele for the Head Coach;
5.3.7 Jucele will offer the Head Coach an allowance of a maximum of $ 000 000 towards rent for accommodation of his choice;
- return economy air tickets to to, however the remuneration of such travel will be limited to the price of a return ticket from Brazil to the Head Coach’s home city. .
5.3.9 The President reserves the right to add additional incentives for the Head Coach during the duration of this contract.
5.4 Jucele will be entitled to make all appropriate deductions in respect of tax and other statutory requirements from these payments or from any sums due to Head Coach at any time when such payments are due to the Receiver of Revenue or other governmental authorities.
- DISCIPLINE AND WORK PERFORMANCE
6.1 The Head Coach agrees to comply with Jucele’s
disciplinary code, as amended from time to time. A copy of the disciplinary code is contained
within Jucele’s Employee Handbook the contents of which the Head Coach is fully
conversant with.
6.2 The Head Coach agrees to be bound by such
rules and regulations as Jucele might impose from time to time.
6.3 The Head Coach will accept input on training methods and systems from the technical team where necessary.
- JOB DESCRIPTION
The Head Coach shall serve as the head coach of Jucele.
7.1 The Head Coach will manage the players’ programme and the playing affairs of Jucele’s Premier League side only, which shall include the responsibility of training the team, coaching the team, team selection as well as substitutions. Jucele will not interfere in any way whatsoever in the coaching, selection or substitutions of the team. The Head Coach will have full control and responsibility in this regard. The Head Coach reserves the right to appoint a Technical Team in consultation with the President of Jucele if he feels it is needed, who will report to the Head Coach
7.2 The Head Coach shall behave in a responsible manner with dignity and integrity and shall not bring Jucele’s good name into disrepute.
7.3 The Head Coach shall report to the President.
7.4 The Head Coach shall follow all reasonable instructions and decisions made by the President.
7.5 The Head Coach will provide the President with a weekly training programme.
7.6 The Head Coach will provide the President with a pre match plan as well as a post match report.
8. MEDIA STATEMENTS
The Head Coach shall be permitted to appear on television, radio and in the printed media strictly on the under-mentioned basis:
8.1 The Head Coach shall at all times uphold the name and reputation of Jucele, its members or players.
8.2 The Head Coach shall not make defamatory statements of Jucele, its President, any player, its staff or officials.
8.3 The Head Coach shall speak to the media on the playing affairs of Jucele’s Premier Soccer League Team only.
8.4 The Head Coach shall not speak to the media on club policy matters.
8.5 The Head Coach shall promote Jucele within the media.
8.6 The Head Coach shall obtain written approval from Jucele before accepting any invitation to write any column for any print media.
- CONFIDENTIALITY AND RESTRAINT
9.1 The
Head Coach agrees that, in the interests of the protection and maintenance of Jucele’s trade secrets
(which for the purpose hereof means Jucele’s
goodwill, technical and business know-how, trade secrets, confidential information and intangible assets in
general) that the Head Coach:
9.2 Will not at any time during the
subsistence of this contract, either utilize personally and/or directly or
indirectly divulge and / or disclose to any third party (except as required by
the terms of the Head Coach’s employment) any of Jucele’s trade secrets.
9.3 Shall treat the terms and
conditions of this contract as well as the confidentiality undertaking as a
confidential matter which may not be divulged to any third party.
9.4 Shall treat as confidential all
details of contracts which Jucele has or will conclude with players; sponsors;
and any third party which he has become privy to in the course of his
employment with Jucele, and shall not divulge to other third parties any
information regarding such trade secrets.
9.5 Will not have any player/agent
dealings within or outside of Jucele.
- ANNUAL BREAK
10.1 The Head Coach is entitled to four
consecutive weeks break, between the two football seasons during a prescribed period
per year.
10.2 The time at which the break will be taken will be determined by
mutual agreement if possible,
failing which Jucele reserves the right to decide when the break may be taken, in accordance with the requirements
of Jucele’ s business.
10.3 This break is to be taken annually and may
only be accumulated. If the annual break is not taken by the conclusion of any 12-month
cycle, the Head Coach will forfeit this break, unless agreement has been
reached with Jucele as to an alternative date that this break will be taken.
- GENERAL
11.1 The Head Coach warrants to Jucele that he has
no interest or obligation which is inconsistent with, or in conflict with this
agreement, or which would prevent, limit or impair the Head Coach’s performance
of any part of this agreement. The Head Coach agrees to notify Jucele
immediately if any such interest or obligation arises.
11.2 The parties warrant each to the other that
they view the terms and conditions set out herein as being reasonable and
necessary in consequence of the specificity of the sport of football and that
they will meet their obligations each to the other in the utmost good faith.
11.3.1 This contract and the documents referred to herein and incorporated by reference constitute the entire agreement between the parties and no alteration; amendment; or consensual cancellation (including in relation to this clause) shall have any force or effect whatsoever save and unless it is reduced to writing and signed by or on behalf of the parties hereto.
11.3.2
In the event of any dispute regarding this agreement, the Head Coach will be
entitled to submit or arbitrate to FIFA, only once the internal remedies of the
local Football League, Association and Country have been exhausted..
11.4 The parties select their addresses as recorded on the front page of this contract as their domicilium citandi et executandi for all purposes under this agreement. Any notice delivered by hand or telefax to that address will be deemed to have been received on the same day as the date of hand delivery or fax.
